Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Biddarthi ("we," "us" or "our"), concerning your access to and use of our website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.

Business Information

As required by the Digital E-Commerce Policy 2021 published by the Commerce Ministry of Bangladesh (clause 3.1.12), we provide the following business information:

The business address provided above matches the address in our Trade License. If there is any change in our business address, we will notify SSLCOMMERZ about it.

User Registration

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

Products and Services

We make every effort to display as accurately as possible the courses, materials, and services that are available on the Site. However, we cannot guarantee that your screen's display of any course or service will be accurate in every detail.

We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or service pricing are subject to change at any time without notice, at our sole discretion.

Purchases and Payment

We accept payments via various methods as displayed on the Site. You agree to provide current, complete, and accurate purchase and account information for all purchases made on the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.

Digital Course Access

Upon successful purchase of a digital course or other educational content, you will be granted access to the content. The access may be unlimited or for a specific duration as indicated during purchase.

The materials provided are for your personal use only and cannot be shared, copied, or distributed without our express written consent.

Delivery Policy

As per the Digital E-Commerce Policy 2021 (clause 3.1.17), we provide the following delivery information:

• Digital Course Access: Immediate access upon successful payment
• Physical Study Materials: Delivery within 3-5 business days within Dhaka and 5-7 business days outside Dhaka
• All deliveries: Will be completed within a maximum of 7 days from the date of purchase

For any exceptional circumstances that may cause delivery delays, we will notify you promptly via email or phone.

Refund Policy

In accordance with the guidelines from the Commerce Ministry, our refund policy is as follows:

• Refund requests must be made within 7 days of purchase for digital courses and within 3 days of delivery for physical materials.
• For digital courses, refunds are eligible if you have accessed less than 20% of the course content.
• For physical materials, products must be returned in their original, unused condition.
• All approved refunds will be processed within 10 working days from the approval date.
• Refunds will be made to the original payment method used for the purchase.

To request a refund, please contact our customer support team at info@biddarthy.com with your order details and reason for the refund request.

User Contributions

Users may post comments, feedback, and other content on the Site as long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable.

We reserve the right to remove or edit user contributions at our sole discretion.

Intellectual Property Rights

Unless otherwise indicated, the Site and all its contents, features, and functionality (including but not limited to all courses, information, software, text, displays, images, video, and audio) are owned by us, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent.

Limitation of Liability

In no event will we, our affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Site, any websites linked to it, any content on the Site or such other websites, or any services or items obtained through the Site.

Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms and Conditions or your use of the Site.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bangladesh.

Changes to Terms and Conditions

We may revise these Terms and Conditions at any time and for any reason by updating this page. All users are encouraged to check this page periodically for any changes. Your continued use of the Site following the posting of revised Terms and Conditions means that you accept and agree to the changes.
